eyeHear Terms of Use

Agreement to Terms

By downloading, installing, or using eyeHear ("the App"), or by using the eyehear.app website (including the support form), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App or website.

These Terms supplement Apple's standard Licensed Application End User License Agreement (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula. In the event of a conflict between these Terms and Apple's EULA, the more restrictive provision applies.

Description of Service

eyeHear is a real-time speech-to-text captioning application for iOS devices designed for people who are deaf or hard of hearing. The App uses Apple's Speech framework to transcribe spoken audio captured by your device's microphone into on-screen captions.

These Terms also apply to your use of the eyehear.app website, including the support form at eyehear.app/support. Submitting the support form constitutes your agreement to these Terms.

Caption Accuracy Disclaimer

eyeHear is an assistive tool provided for general informational and convenience purposes only.

Captions produced by eyeHear are machine-generated estimates and are inherently subject to error. The captions displayed may be inaccurate, incomplete, delayed, or missing entirely due to factors including but not limited to:

  • Background noise, crosstalk, or poor room acoustics
  • Speaker accents, speech patterns, volume, or distance from the microphone
  • Microphone quality and device hardware limitations
  • Network connectivity and the availability of Apple's speech recognition services
  • Specialized, technical, or uncommon vocabulary, names, or numbers

eyeHear is not a substitute for a qualified human interpreter, CART (Communication Access Real-time Translation) provider, or other professional accommodation. You should not rely on eyeHear for any communication where inaccurate, incomplete, or delayed captions could result in harm — including emergency, medical, legal, financial, employment, or other safety-critical or consequential situations.

You are solely responsible for how you use the captions produced by the App. eyeHear, LLC assumes no responsibility for any decision made or action taken in reliance on captions produced by the App.

Acceptable Use

You agree to use eyeHear only in compliance with all applicable laws and regulations. You agree not to:

  • Rely on eyeHear as your sole or primary means of communication where inaccurate captions could cause harm
  • Use the App to capture, transcribe, record, or share the speech of others without obtaining any consent required by applicable law
  • Use the App in any manner that violates the rights of others or any applicable law
  • Reverse engineer, decompile, or disassemble the App

Intellectual Property

EYEHEAR is a registered trademark of eyeHear, LLC (U.S. Reg. No. 5,397,223). The eyeHear logo and the tagline "Caption Any Conversation" are trademarks of eyeHear, LLC. All associated content is the property of eyeHear, LLC. Your use of the App grants you a limited, non-exclusive, non-transferable license to use the App on your Apple devices in accordance with these Terms and Apple's EULA. Nothing in these Terms grants you any right to use the eyeHear name, logo, or other trademarks without the prior written permission of eyeHear, LLC.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EYEHEAR, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES OF ACCURACY, RELIABILITY, OR COMPLETENESS OF CAPTIONS
  • WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS

No advice or information obtained from eyeHear, LLC or through the App shall create any warranty not expressly stated in these Terms.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EYEHEAR, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Personal injury, or loss arising from missed, inaccurate, or delayed communication
  • Loss of data, revenue, or profits
  • Any damages arising from reliance on captions displayed by the App

IN NO EVENT SHALL EYEHEAR, LLC'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP.

This limitation applies regardless of the legal theory on which the claim is based, including negligence, breach of contract, strict liability, or any other theory, even if eyeHear, LLC has been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless eyeHear, LLC, its officers, directors, employees, and agents from and against any third-party claims, demands, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • Your use of, or reliance on, the App or the captions it produces
  • The quality, accuracy, completeness, reliability, or timeliness of any captions produced by the App, including any inaccurate, incomplete, delayed, or missing captions
  • Any decision made or action taken — by you or any third party — based on captions produced by the App
  • Your capture, transcription, recording, or sharing of the speech of others, including any claim that you failed to obtain any consent or authorization required by applicable law
  • Your violation of these Terms or of any law or regulation

Apple's Standard EULA

Your use of eyeHear is also governed by Apple's standard Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula.

Changes to These Terms

eyeHear, LLC reserves the right to modify these Terms at any time. Changes will be posted at eyehear.app/terms and noted in the release notes of app updates. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Chesterfield County, Virginia, or the United States District Court for the Eastern District of Virginia.
